Not So Fast Joe! Legal Group Claims Student Debt Cancellation Plan Is ‘Flagrantly Illegal’

We all knew Joe Biden wasn’t going to get away with canceling student debt for millions of Americans. It was the most absurd promise we’ve ever heard, yet so many believed him – and unless you’ve been living under a rock, you already know, it’s not even Biden’s decision to begin with! You know, there’s this thing called CONGRESS! They kind of have to approve these things…

But Joe didn’t want you to know that – at least not until after the midterms. He was hoping he could fool the American people long enough to get their vote before being exposed.

Unfortunately for Joe, the gig is already up, and one legal group is already taking the White House to court over a promise he never had the right to make in the first place.

A conservative law foundation filed a major legal challenge this week to Joe Biden’s outrageous $400 billion package to forgive student debt for some Americans, according to The First.

The suit from the Pacific Legal Foundation claims the White House’s order is “flagrantly illegal” because the measure was not approved by Members of Congress.

“Congress did not authorize the executive branch to unilaterally cancel student debt,” said Caleb Kruckenberg, an attorney at Pacific Legal Foundation. “It’s flagrantly illegal for the executive branch to create a $500 billion program by press release, and without statutory authority or even the basic notice and comment procedure for new regulations.”

“Cancelling student debt is unjust to those who have paid their loans or never took any. It will only lead to more calls for government intervention in education at taxpayers’ expense,” said Steve Simpson, senior attorney at Pacific Legal Foundation. “Loan cancellation will make Americans more divided, as those who paid their loans—or never went to college—will have good reason to think that we no longer have a government of, by, and for the people.”

In August 2022, President Biden announced his plan to cancel up to $20,000 in student loan debt per person for more than 40 million Americans. The Department of Education’s justification relies on an inapplicable, 20-year-old law: The HEROES Act, which was intended as an aid to veterans and their families, allows the government to modify student loans during times of war or national emergency.

“Whatever the motives of the president for transferring massive amounts of student debt to taxpayers in a rushed, haphazard manner, it certainly seems like an election-year ploy. That is one of the predictable effects of the president usurping Congress’s power to make law. Not since President Trump imposed a nationwide eviction moratorium before the 2020 elections has a president abused his power so profoundly,” the Pacific Legal Foundation posted on their website.

The White House unveiled the proposal in August.

“Let’s be clear. I hear it all the time. How do we pay for it? We pay for it by what we’ve done. Last year, we cut the deficit by more than $350 billion. This year, we’re on track to cut it by more than 1.7 trillion by the end of this fiscal year. The single largest deficit reduction in the single year in the history of America. And the Inflation Reduction Act is going to cut it by another 300 billion over the next decade, because Medicare will be paying less for prescription drugs. And over a trillion dollars we added out for the next two decades. The point is this, there is plenty of deficit reduction to pay for the programs, cumulative deficit to pay for programs many times over. I will never apologize ever helping Americans working… working Americans,” explained Biden.

Nice try Joe! That’s hardly an answer, but then again your administration never provides clarity on pretty much anything that comes out of your mouth. Good thing the legal group suing you has.
