On April 7, 2022, the Senate confirmed Ketanji Brown Jackson as the latest Justice in the United States Supreme Court.  She will take the seat of retiring Supreme Court Justice, Stephen Breyer.  During her Senate Confirmation Hearings, her judicial record was revealed to be less than sterling.  Judge Jackson handed out dramatically lower sentences in some of the most horrific criminal cases, well outside of the practical application of existing Criminal Law.  Examples of her judicial activism regarding sentencing included the application of “slap on the wrist” punishments concerning cases involving child pornography. These revelations regarding her judicial style have led many Republican Senators to the conclusion that Judge Jackson will be an activist jurist on the Supreme Court, basing her judgments on personal opinion more than on the fair application of the Law.

“Based on Judge Jackson’s abysmal record on criminal sentencing, the repeated incidents in which she has substituted her political preferences in place of the law, and her inability to explain her judicial philosophy, I voted against confirming her to the Supreme Court.” – Ted Cruz

Judge Jackson secured her nomination by a 53-47 Senate Vote.  Every Democrat voted for her confirmation as did three Republicans; Senators Mitt Romney, Susan Collins, and Lisa Murkowski.  The mainstream press was abuzz with talking points congratulating Judge Jackson for being the “first African-American woman in history to join the Supreme Court”.

Although I find it ironically humorous that the press confirmed Judge Jackson as being a woman, whereas Judge Jackson could not define what a woman was during confirmation, I am mildly concerned about her rulings in criminal cases.  However, when it comes to the breakdown of the Supreme Court, her confirmation doesn’t spell a potential disaster for this important branch of government.  Justice Breyer was appointed by former President Bill Clinton in 1994, and his Supreme Court Decisions have consistently leaned Left and he has been accused of eschewing the application of Law in favor of personal opinion.   This nomination has a zero-net value for the political elites that wanted her on the bench of the Supreme Court.

Much to my chagrin, Republican Lawmakers have a weakness.  The inability to plan for the long game.  It has been a flaw in the ranks for decades.  What’s been on the Left’s “To Do” list has been to discredit, dishonor, and destroy Supreme Court Justice Clarence Thomas since his nomination in 1990.  Say what you will, but Democrats have a long memory, but little imagination.

The circus from Justice Cavanaugh’s Senate Confirmation was a repeat performance of Justice Thomas’ Confirmation over thirty years ago.  Utilizing thug tactics involving an unsubstantiated “victim”, who gave shady testimony about sexual harassment, Justice Thomas’ nomination was held in suspended animation for over three months.  The final vote to confirm Justice Thomas was 52-48.  Forty-one Republican and eleven Democrat confirmation votes made him the 106th Supreme Court Justice.

Since the nomination of Ketanji Brown Jackson and appointment to the Supreme Court, Democrat Lawmakers and their allies in the mainstream have been calling for Justice Thomas’ impeachment following the release of his wife’s texts that showed her support for President Trump and the opinion that the election needed a recount.  Democrats jumped at the bait to call on Justice Thomas to resign or be impeached.  The main talking point that has been circulating is that Justice Thomas is violating a “code of ethics” for not recusing himself from court cases involving the “January 6, 2021 insurrection”.

“Democrats have been criticizing Thomas for not recusing himself from cases related to the Jan. 6, 2021 Capitol riot, after it was revealed that his wife sent text messages to then-White House chief of staff Mark Meadows urging him to challenge Donald Trump‘s 2020 election loss…Ocasio-Cortez joins Reps. Veronica Escobar, D-Texas, Hank Johnson, D-Ga., Ilhan Omar, D-Minn., and Nydia Velazquez, D-N.Y., in calling for Thomas to leave the bench or face impeachment proceedings.”

The mainstream has been so abuzz with this latest move that even Speaker Nancy Pelosi had to fight her way to an open microphone to join the mob.

“If your wife is an admitted and proud contributor to a coup of our country, maybe you should weigh that in your ethical standards… I don’t think he should have ever been appointed.”

This push to oust Justice Thomas is just another sneaky tactic to stack the deck in their political favor.  Paint Justice Thomas’ wife as an “insurrectionist” for expressing her concerns over the 2020 election, and linking it to Justice Thomas’ ability to adjudicate is just sleazy.  If they somehow get their way to oust him and have another chance to nominate a legal activist to the bench, the reality of independent co-equal Branches of Government will become nothing but a fond memory.
